When the laws are incompatible with the dharma then a person should follow dharma. When the people who are interpreting the laws are insensitive to the suffering of fellow human being, as it happened during Delhi traders strike and think that they should not be influenced by such sufferings, then what Krishna Iyer says is correct. That many judges live in the fantasy world. Markendaya Katju, while serving as chief judge of madras high court, observed that judges are servants of people. We should respond positively to the people expectation. If a bench is not properly deciding a case, what happens is that mayhem, violence, suffering of affected people. All this happened in the delhi traders case. Talking about the need for a court, he mentioned that the court is needed to solve the problem peacefully. Well, if the court itself creates a situation in which people get angry and start burning vehicles, what should we do?
